WARRANTY & RETURNS

TERMS AND CONDITIONS OF CANCELLATION AND RETURNS

Parties
This Agreement is made between LOJIMAKS RADIATOR HEATING & COOLING SYSTEMS INDUSTRY AND TRADE INC. (hereinafter referred to as the “Seller”) and the purchaser placing the order (hereinafter referred to as the “Buyer”), for the purpose of setting out the conditions relating to the sale, cancellation and return of decorative radiators and towel warmers.

1. Scope and Purpose

This Agreement governs the order, cancellation, return and warranty terms applicable to products supplied by the Seller within the scope of B2B (business-to-business) sales.

The Buyer acknowledges that it is acting in the capacity of a trader and not as a consumer. Accordingly, the provisions of consumer protection legislation shall not apply.

2. Orders and Payment

Orders are accepted in writing or electronically and become binding only upon confirmation by the Seller.

The method of payment shall be agreed between the parties. No order will be dispatched unless payment has been received in full.

For bespoke or made-to-order products (including but not limited to custom dimensions, finishes, or project-specific designs), cancellation by the Buyer is not permitted.

3. Order Cancellation

For cancellations of standard product orders made prior to dispatch, any payment received will be refunded within seven (7) working days.

Once dispatch has commenced, cancellation is no longer possible.

Bespoke or made-to-order items (including custom-sized radiators, special colour coatings, etc.) are strictly non-cancellable and non-refundable.

4. Delivery

Delivery shall be made to the address specified by the Buyer.

At the point of delivery, the Buyer must inspect the quantity, packaging, and external condition of the goods. Any damage must be recorded immediately with the carrier by means of a delivery damage report.

The Seller accepts no liability for loss or damage occurring during transit.

5. Returns

Returns are only permitted in cases of defective goods.

Defects must be notified in writing within seven (7) working days of delivery.

No goods may be returned without prior inspection and written authorisation from the Seller.

Returned goods must:

  • Be in their original packaging,

  • Include all accessories,

  • Be unused and uninstalled.

Unless otherwise agreed in writing, the Buyer shall bear the cost of return carriage.

6. Return Procedure and Refunds

Once a return request is approved, the goods will be inspected by the Seller within ten (10) working days of receipt.

If the goods are found to be defective, the purchase price shall be refunded to the Buyer or replacement goods supplied.

Goods failing to meet the return conditions shall be returned to the Buyer, and no refund shall be issued.

7. Warranty Terms

Decorative radiators and towel warmers supplied by the Seller are warranted for five (5) years against manufacturing defects.

The warranty period commences on the date of delivery to the Buyer.

Under warranty, defective products will be repaired or replaced free of charge.

To claim under warranty, the Buyer must:

  • Provide the original invoice, and

  • Return the product to the Seller for technical inspection.

The warranty does not cover:

  • Incorrect installation or installation by unauthorised persons,

  • Use contrary to the instructions,

  • Damage sustained during transportation,

  • Incorrect storage or handling by the Buyer,

  • Impact, breakage, liquid ingress, corrosion due to improper chemical use,

  • Normal wear and tear.

Any replacement products or parts supplied under warranty shall be covered only for the remainder of the original warranty period.

8. Disclaimer of Liability

The Seller shall not be held liable for defects arising from misuse, improper installation, or plumbing errors.

The Seller shall not be liable for indirect or consequential losses, including but not limited to loss of business or loss of profit, arising from the use of the products.

9. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

The parties agree to endeavour in good faith to resolve any disputes amicably before resorting to legal proceedings.

10. Commencement

This Agreement shall enter into force upon the Buyer placing an order.

By placing an order, the Buyer confirms that it has read, understood, and accepted all the terms of this Agreement.
